Residence Permits and Permanent Residency in Kenya

Kenya has no stand-alone “residence card”. Foreigners live in Kenya on a work permit or a pass issued by the immigration service: employees hold a Class D permit, investors and business owners a Class G permit, family members a Dependant’s Pass, and people living on a steady foreign income can apply for Class K (ordinary residents). The permit is the residence status; if it is not renewed, the right to stay ends with it.

After holding work permits for seven years and living in Kenya continuously for the last three, you can apply for Permanent Residence. Permanent Residence does not need renewing, but holders aged 18 and over must carry a foreigner certificate (the “alien card”), renewed every three years [7][9].

Issuing authority and how to apply

Permits and passes are issued by the Directorate of Immigration Services under the Ministry of Interior and National Administration. All applications go through the eFNS portal; the printed permit is then endorsed at an immigration office [1][2]. Headquarters are at Nyayo House, Nairobi.

Under section 56 of the Kenya Citizenship and Immigration Act 2011, a foreign national living in Kenya continuously for more than three months must register with an immigration officer and report changes of address and travel as prescribed. Breaches carry a fine of up to KES 100,000, up to three years in prison, or both [10].

Residence status types at a glance

Fees below are as shown on the immigration website in October 2026; the East African Community waivers do not apply to Chinese citizens [3][4][5][6]. The website does not state permit validity; issuance fees are charged per year.

Class K does not allow work; it suits retirees and people living on foreign income.

How work permits and residence connect

For most Chinese in Kenya, residence rests on a Class D or Class G work permit. Documents and steps are on our page Kenya visas and work permits; company registration and tax numbers needed for Class G are covered in Registering a company in Kenya. Points that matter for residence:

  • Class D is tied to the employer. It covers employment by a specific employer [3]; changing employer means applying for a new permit.
  • Start the permitted activity on time. A permit lapses if the holder does not take up the authorised activity within 90 days of issue without written approval [10].
  • First applications must be approved before entry. Since August 2018 Immigration has stopped approving first-time work permit and special pass applications from people already in Kenya; you cannot enter on a business visit and switch [12][13]. This is a 2018 rule and we found no newer official notice; confirm with Immigration before applying.

Renewals

  • Apply early. According to 2018 industry alerts, renewals should be filed three to four months before expiry; renewals can be processed in Kenya only while the current permit is valid, and holders of expired permits cannot wait in Kenya for the decision [12][13].
  • Documents. Class D renewals add the individual’s tax compliance certificate; Class G renewals add audited accounts for the last two years [3][4].
  • Fees. The annual issuance fee applies again, as in the table. The MOFCOM guide (2025) gives KES 220,000 (D) and 280,000 (G) a year, which differs from the official website; go by the amount shown in eFNS [1].

Permanent Residence

Permanent Residence is issued under sections 37 to 39 of the Kenya Citizenship and Immigration Act. Four groups may apply [7]:

Category Requirement
A Former Kenyan citizens by birth who renounced Kenyan citizenship and whose new country does not allow dual citizenship
B (lawful residents) Held work permits for at least seven years and lived in Kenya continuously for three years before applying
C Children of Kenyan citizens born abroad who acquired the citizenship of their country of domicile
D Spouses of Kenyan citizens married for at least three years

Most Chinese applicants use Category B, a few Category D. The process [8]:

  1. Apply in eFNS, upload documents and pay the processing fee.
  2. Download the Permanent Residence checklist, Form 23, the completed questionnaire and the payment receipt.
  3. Submit everything on the checklist at Nyayo House, 17th Floor, North Wing, Nairobi.

Permanent Residence does not pass to family members; each person applies separately. It has no expiry date as long as the holder obeys Kenyan law, and holders can later apply for citizenship if they qualify [9]. Permanent residents may live, work, study and own property in Kenya [10].

It can be lost: the Act lists, among other grounds, obtaining it by fraud, living outside Kenya for two years (except former citizens by birth), a conviction within five years of grant for an offence punishable by three years or more, and a removal order [10].

Citizenship and dual nationality

Foreigners can apply for citizenship by registration as lawful residents under section 13 (Form 10): seven years’ ordinary residence immediately before applying, the whole of the last 12 months in Kenya, knowledge of Kiswahili or a local dialect, and the intention to keep living in Kenya, among other conditions [10][11]. Spouses of Kenyan citizens apply under section 11 after at least seven years of marriage and with residence status (Form 8) [10].

China does not recognise dual nationality for its citizens, and a Chinese citizen settled abroad who voluntarily acquires a foreign nationality automatically loses Chinese nationality (Nationality Law, articles 3 and 9) [14]. Kenyan Permanent Residence does not affect Chinese nationality; naturalisation does.

Spouses and children

Spouses and children of permit holders apply for a Dependant’s Pass with Form 28, a letter to the Director General, both passports, proof of relationship such as marriage or birth certificates (translated if not in English), proof of income, and the principal’s work permit with at least six months’ validity left [6]. Chinese marriage and birth certificates usually need notarisation and authentication first; see Notarization, Apostille and Consular Legalization.

A Dependant’s Pass does not allow work; a spouse who wants a job needs a separate work permit. Ask the school and Immigration whether a child at school in Kenya needs a Student’s Pass.

If a permit lapses or is cancelled

  • Being unlawfully present and working without a permit are offences, and so is knowingly employing someone without one. Penalty: a fine of up to KES 500,000, up to three years in prison, or both [10].
  • For an overstay of no more than ten days, an immigration officer may let a departing foreigner pay an on-the-spot fine of up to KES 50,000 [10].
  • The Cabinet Secretary may order removal of a person unlawfully present and bar return indefinitely or for a set period [10].
  • The MOFCOM guide warns: do not start work before the permit is approved, or you risk detention, prosecution, fines and deportation [1].

For police and immigration checks see Kenya safety guide; if detained, contact the embassy, see Consular protection for Chinese citizens.

Huaqiao (overseas Chinese) status

Under the 2009 rules of the State Council Overseas Chinese Affairs Office, a huaqiao is a Chinese citizen settled abroad; “settled” means holding long-term or permanent residence in the host country and having lived there for two continuous years with at least 18 months of actual stay within those two years [15]. Holders of Kenyan Permanent Residence who meet the residence test are generally recognised; whether a work permit counts as “long-term residence” is for the overseas Chinese affairs authorities in China to decide.

Huaqiao status is used for some overseas-Chinese matters handled in China; ask the overseas Chinese affairs office where your hukou is registered. Huaqiao remain Chinese citizens and must keep their passports valid; see Renewing a Chinese passport in Africa.

Common mistakes

  • Using unofficial websites or middlemen who “handle everything”. Apply in eFNS and check the amount and domain before paying.
  • Assuming a Dependant’s Pass or Class K allows work.
  • Working for a new employer on the old Class D permit.
  • Starting the renewal only after the permit has expired.
