Foreigners living long-term in Zambia must hold one of the temporary residence permits issued by the Department of Immigration (employment, investor, spouse, study and others) or a Residence Permit, which confers permanent residence [1][2]. Chinese passport holders mostly use Employment Permits and Investor’s Permits; holding an Employment Permit for more than 10 years, or an Investor’s Permit for more than 3 years, makes you eligible to apply for a Residence Permit [1].
The issuing body is the Department of Immigration under the Ministry of Home Affairs and Internal Security, and applications go through the Immigration eServices portal. This page reflects the position as of October 2026, based on the Immigration and Deportation Act 2010, the Immigration website, the 2024 fee notice and the 2025 MOFCOM country guide.
How residence works in Zambia
Under the Immigration and Deportation Act 2010, a foreigner who is not an established resident and does not hold a Residence Permit may enter and stay only on one of the temporary residence permits set out in the Act [2]. Common rules [2]:
- holders may only do what the permit specifies, and may not take up any other business, employment or study;
- a permit issued outside Zambia takes effect only on admission;
- you can apply from inside Zambia to change status (to another temporary permit or to a Residence Permit), but the application does not change your status or let you stay while it is pending;
- the Director-General can cancel a temporary residence permit by written notice and set a deadline to leave; the holder may make representations before the deadline.
There is no separate residence card issued apart from the work permit: the Employment Permit or Investor’s Permit is itself the basis of residence. Entry rules and full work-permit document lists are on Zambia visas and work permits.

How work and investor permits relate to residence
Employment Permit
Only an employer, a practising lawyer or a registered immigration consultant can apply, and the applicant should stay outside Zambia until approval [1]. According to MOFCOM, work permits are usually valid for 2 or 3 years and can be extended for the same period; digital cards have been issued since February 2020 [4].
The permit is tied to the employer. Changing employer requires a variation with qualifications, a release letter from the old employer and an offer letter from the new one [1]; the fee has been K12,000 since August 2024 [3]. When a foreign employee resigns or is dismissed, the employer must surrender the permit within one month and bear repatriation costs, or commit an offence with a fine of up to 200,000 penalty units [1]. After leaving the job, the old permit is no longer a basis for residence.
Investor’s Permit
Holders can add a company, change the nature of business, or add a spouse and children to the permit [1]. Renewal requires tax clearance or VAT receipts, an audit report from a ZICA-registered firm and a current bank statement, followed by an immigration inspection [1]. A company that is not actually trading or has gaps in its tax record will struggle to renew. Company registration is covered in Registering a company in Zambia.
Renewals: documents, fees and timing
The Act allows holders of temporary residence permits to apply to the Director-General for an extension [2], and staying after a permit expires is an offence [2]. The Immigration website does not say how far ahead to renew [1]; MOFCOM says processing usually takes 2 to 6 months and sometimes over a year [4], so apply several months ahead and confirm timing with Immigration or your lawyer.
- Employment Permit: employer’s covering letter, extended contract, passport copy, proof of payment [1];
- Investor’s Permit: covering letter, tax clearance, audit report, lease where applicable, bank statement, passport copy, proof of payment [1];
- Spouse Permit: covering letter, spouse’s consent letter, proof of payment [1];
- Study Permit: letter from the school, latest results or progress report, proof of payment [1].
| Item (private sector, from 19 Aug 2024, kwacha) | Issue | Renewal |
|---|---|---|
| Employment Permit | 24,000 | 28,000 |
| Investor’s Permit | 16,000 | 20,000 |
| Spouse Permit | 3,000 | 6,000 |
| Study Permit | 9,000 | 12,000 |
| Residence Permit | 20,000 | — |
Figures are from the 2024 Immigration fee notice [3]. MOFCOM says Immigration does not accept cash; fees are paid at a bank with a payment slip or by mobile money [4].
Permanent residence: the Residence Permit
The Residence Permit is what people usually mean by Zambian permanent residency or a “green card”. Under section 20 of the Act and the Immigration website, eligible applicants include [1][2]:
- people who have held an Employment Permit for more than 10 years;
- foreigners who have held an Investor’s Permit for more than 3 years;
- spouses of citizens who have held a Spouse Permit for at least 5 years;
- children and dependants under 21 of an established resident or Residence Permit holder;
- retirees who can show a lifetime pension or annuity, or a prescribed net worth plus a prescribed deposit in a Zambian account (amounts are not published online; check with Immigration);
- children of citizens, at any age, among others.
The Act also requires that the applicant is not an illegal immigrant, has adequate knowledge of English or a commonly used local language (an officer may set a test), and intends to stay in Zambia for more than 10 years [2]. Applicants aged 16 and over also need two testimonials from people who have known them for at least 3 years [1]. The fee is K20,000 [3].
Holders have the rights and duties of a citizen except those the law or Constitution reserves to citizens [2]. MOFCOM notes that permanent residents can obtain state land [4], while Employment Permit holders may not buy land [1].
When a Residence Permit lapses
- if the holder does not enter Zambia within 6 months of issue (unless a later date is endorsed);
- if the holder is away for more than 6 months without written notice of intent to return;
- if the holder is away for more than 12 months [1][2].
Holders must report a change of address to the nearest immigration office; failing to do so carries a fine of up to 100,000 penalty units or up to 12 months in prison [2]. Anyone who spends long periods in China or doing business elsewhere should watch the 12-month limit.
Citizenship and dual nationality
Under Article 37 of the Constitution as amended in 2016, a person aged 18 or over who has been continuously resident in Zambia for at least 10 years immediately before applying may apply to the Citizenship Board of Zambia for registration; a person married to a citizen for at least 5 years has a separate route [5]. Zambia allows its citizens to hold dual citizenship [4][5].
China does not recognise dual nationality. Article 9 of the PRC Nationality Law provides that a Chinese national settled abroad who voluntarily acquires a foreign nationality automatically loses Chinese nationality [6]. After naturalising in Zambia you would need a visa to visit China. For passport matters see Renewing a Chinese passport in Africa.
Dependants: spouse and children
- Employment or investor permit holders can apply for a variation to add a spouse and children [1]. Fees: K4,000 on an Employment Permit, K8,000 on an Investor’s Permit [3].
- Parents and dependants over 18 may apply for a Temporary Permit when directed by Immigration [1].
- Spouse Permits are only for spouses of citizens, established residents or Residence Permit holders; a first application needs the spouse’s consent letter, proof of the spouse’s status, the marriage certificate and proof of sustenance, among other items [1].
- Children studying in Zambia for more than 3 months need a Study Permit; a first application needs a medical report from a Zambian government facility [1].
Chinese marriage and birth certificates usually need notarisation and legalisation before use in Zambia; see Notarization, apostille and consular legalization.
If a permit expires or is cancelled
- A person whose permit has been revoked or has expired falls into a class of prohibited immigrants in the Act’s schedule, and remaining after expiry is an offence [2].
- Offences without a specific penalty carry a fine of up to 200,000 penalty units or up to 2 years in prison, or both, and a foreigner’s permit may also be varied or revoked [2].
- Wilfully staying after a notice to leave carries up to 100,000 penalty units or 12 months in prison [2].
- The Minister can order an illegal immigrant deported and barred for a set period or indefinitely; returning unlawfully after removal carries up to 3 years in prison [2].
The kwacha value of a penalty unit is set by separate legislation and is not converted here. For handling document checks, see Zambia safety guide.
Common pitfalls
- Agents and fake permits: only an employer, practising lawyer or registered immigration consultant can submit an Employment Permit application [1]. Check an agent’s credentials and verify any permit with Immigration. Forging or using a forged permit, or lying to an immigration officer, is an offence [2].
- The permit covers only what it says: opening your own shop on an Employment Permit is gainful activity outside the permit [1]; vary or change the permit first.
- New passport: after renewing your passport, the permit must be transferred; the fee is K2,000 [3].
Huaqiao (overseas Chinese) status
Under the 2009 rules of the Overseas Chinese Affairs Office of the State Council, huaqiao are Chinese citizens settled abroad; “settled” means holding long-term or permanent residence rights in the host country and having lived there for two consecutive years, with at least 18 months of actual presence in those two years [7]. The Office’s explanation adds that a citizen without long-term or permanent residence rights who has held lawful residence for 5 or more consecutive years and spent at least 30 months there within those 5 years is also treated as huaqiao [8]. Workers posted abroad on labour contracts are not huaqiao while working abroad [7].
A Chinese citizen with a Zambian Residence Permit who meets these presence tests generally qualifies; whether an Employment or Investor’s Permit counts as a long-term residence right is decided by the overseas Chinese affairs office in China. Huaqiao status matters for some domestic administrative matters; follow your local office’s view. For the community in Zambia, see Chinese community in Zambia.
